ARTICLE 1 - PARTIES

1.2- BUYER: the individual or organisation whose details appear on the page protected by SSL encryption in the electronic environment and who, by ordering the products listed on this invoice, confirms the accuracy of the identity details provided.

ARTICLE 2 - SUBJECT

The subject of this agreement is the determination of the rights and obligations of the parties, in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures for the Implementation of Distance Contracts, in relation to the sale and delivery of the product ordered electronically by the BUYER from the SELLER's frobot.com.tr website, the sale price of which is stated in the order details and on the invoice.

ARTICLE 3 - PRODUCT SUBJECT TO THE AGREEMENT

PRODUCT 3.1- Type: The type, kind, quantity, brand/model, colour and sale price of the products are as stated on the information cards and as shown in the shopping basket and on the front of the invoice.

3.2- Method of Payment: As stated on the front of the invoice. Open invoices, project purchases, works carried out under contract, cash-on-delivery shipments or purchases by cheque are subject to special terms.

3.3- Interest: Furthermore, since instalment sales are made only with bank credit cards, the BUYER accepts, declares and undertakes that they will separately confirm the applicable interest rates and information on default interest with their bank, and that, pursuant to the provisions of the legislation in force, the provisions relating to interest and default interest will be applied within the scope of the credit card agreement between the Bank and the BUYER.

Credit Card Refund Procedure: In cases where the buyer exercises the right of withdrawal, or where the product subject to the order cannot be supplied for various reasons, or where a refund to the Consumer is ordered by decisions of the Arbitration Committee, if the purchase was made by credit card and in instalments, the credit card refund procedure is as set out below:

If, under the terms of the agreement with the bank, collections made in instalments from the customer's credit card have been credited to our accounts in a single payment, the bank makes the refund to the customer in a single payment; if they were credited month by month, the refund is made month by month. Exceptions to this are at the bank's discretion. In the event of the return of goods and services purchased by card, frobot.com.tr cannot make a payment in cash to the Customer, in accordance with the agreement it has concluded with the Bank.

3.4- Method and Address of Delivery: Delivery Address: As stated on the order form. Invoice Address: As stated on the order form. Delivery Time: A maximum of 30 working days. For orders placed by 15.30, products held in our warehouse stock are dispatched the same day, products held in supplier stock within 24/48 hours, and special import products within 30 working days. For products that will exceed the maximum period, the order may be placed on hold or cancelled in line with the BUYER's instructions. Delivery will be made by hand at the BUYER's address stated above through the contracted courier company. Even if the BUYER is not present at their address at the time of delivery, the SELLER will be deemed to have fully and completely performed its undertaking. For this reason, any loss arising from the BUYER taking delivery of the product late, together with any costs arising from the product waiting at the courier company and/or the shipment being returned to the SELLER, shall also belong to the BUYER. Shipping Fee: Calculated at the time of dispatch and, unless stated otherwise, paid by the customer.

ARTICLE 4 - GENERAL PROVISIONS

4.1- The BUYER declares that they have read and become informed of the preliminary information regarding the essential characteristics, sale price and method of payment of the product subject to the agreement, as well as delivery, on the frobot.com.tr website, and that they have given the necessary confirmation electronically.

4.2- The product subject to the agreement is delivered to the BUYER or to the person/organisation at the address indicated by them within the period explained in the preliminary information on the website, depending on the distance of the BUYER's place of residence for each product, provided that the statutory period of 30 days is not exceeded.

4.3- If the product subject to the agreement is to be delivered to a person/organisation other than the BUYER, the SELLER cannot be held liable if the person/organisation to whom delivery is to be made refuses to accept the delivery.

4.4- The SELLER is responsible for delivering the product subject to the agreement in sound and complete condition, in accordance with the qualities stated in the order, and together with any warranty documents and user manuals.

4.5- For the delivery of the product subject to the agreement, the signed copy of this agreement must have reached the SELLER and the price must have been paid by the method of payment preferred by the BUYER. If for any reason the price of the product is not paid or is cancelled in the bank records, the SELLER shall be deemed released from the obligation to deliver the product.

4.6- If, after delivery of the product, the BUYER's credit card is used unlawfully or unfairly by unauthorised persons through no fault of the BUYER, and the relevant bank or financial institution therefore does not pay the price of the product to the SELLER, the product must be sent to the SELLER within 3 days, provided that it has been delivered to the BUYER. In that case the shipping costs shall belong to the BUYER.

4.7- Products sold with or without a warranty certificate that are faulty or defective may be sent to the SELLER so that the necessary repair can be carried out by an authorised service within the warranty terms; in that case the shipping costs will be borne by the BUYER.

ARTICLE 5 - RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw by rejecting the goods within 7 days of the delivery of the product subject to the agreement to them or to the person/organisation at the address indicated by them. The price of the product is refunded to the BUYER within 10 days of the date on which the Consumer's notice of withdrawal reaches the SELLER. The shipping cost of a product returned by reason of the right of withdrawal is borne by the BUYER. Pursuant to General Communiqué No. 395 on the tax procedure law, in order for return transactions to be carried out, the relevant sections of the invoice sent to you containing a return section must be completed in full, signed and sent back to us together with the product.

ARTICLE 6 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for products which by their nature cannot be returned, single-use products, copiable software and programs, products that cannot be resold after assembly or after their packaging has been opened, products that perish quickly or whose expiry date has passed. In order to exercise the right of withdrawal, the packaging of the product must be unopened and undamaged and the product must be unused. Products which by their nature cannot be returned may not be returned unless they turn out to be faulty or defective.

ARTICLE 7 - DEFAULT PROVISIONS Pursuant to the final paragraph of Article 9 of the Regulation on Distance Contracts, if the SELLER frobot.com.tr is unable to fulfil its obligations under the agreement on the grounds that performance of the goods or service subject to the order has become impossible (a situation in which the product cannot be supplied from the supplier company in any way), it undertakes to notify the consumer of this situation before the expiry of the period of the performance obligation arising from the agreement. In that case, frobot.com.tr is entitled to terminate the agreement immediately and undertakes to refund the price of the product ordered by the customer and any documents creating an obligation. If frobot.com.tr is unable to deliver the product subject to the agreement within the period due to force majeure events that may prevent it from fulfilling this obligation, or due to adverse weather conditions preventing transport, interruption of transport, fire, earthquake, flood and similar natural disasters and similar events, the BUYER accepts in such cases that frobot.com.tr bears no liability whatsoever and may exercise one of the rights to have the order cancelled or to have the delivery period postponed until the impeding circumstance is removed. If the BUYER cancels the order, the amount paid is repaid to them within 10 days. In instalment purchases made by credit card, the above procedure for refunds to the credit card is accepted by the BUYER.

ARTICLE 8 - CASH ON DELIVERY PROVISIONS

8.1- Membership Requirement: In order to place an order with cash on delivery, membership of the site is required. Cash on Delivery orders are not accepted from outside the system or via Quick Order.

8.2- Method of Payment: For cash-on-delivery shipments, payment may be made in cash or by credit card, depending on the form of agreement with the courier company. Partial or instalment payment of the product price is not possible for cash-on-delivery shipments.

8.3- For cash-on-delivery shipments the customer cannot benefit from the extra bank-transfer discount of 5 granted for all products. Other campaign discounts granted for products remain valid as they are.

8.4- Confirmation: Where deemed necessary, confirmation may be obtained by telephone from our customers before dispatch for orders placed with the Cash on Delivery option. For this reason it is the customer's responsibility to verify the accuracy of the contact details entered into the system. The Turkish Republic Identity Number must always be stated in orders. Where a corporate invoice is requested, an identity number belonging to the person placing the order must likewise be entered.

8.5- The courier officer is entitled to request proof of identity before delivering the product to the person who placed the order. Before making payment, the customer likewise has the right to request proof of identity from the courier officer.

8.6- For orders placed with cash-on-delivery shipment in amounts below a certain figure or above the upper limit set by the courier company, a separate "Collection Service Fee" is charged. This fee does not cover the courier transport service fee.

8.7- For cash-on-delivery shipments that have been completed, confirmed by telephone, dispatched and not accepted, the costs will be accrued and collected. The supply of the product and the outbound and return courier transport costs will be requested and collected against an invoice.

8.8- To place an order with the cash on delivery and credit card options it is necessary to be over 18 years of age. The person placing the order is responsible for the accuracy and validity of the information given during the ordering process. If the person placing the order is not of age or lacks legal capacity, collection will be requested from their guardian. If an order placed in this way is cancelled, our company reserves the right to claim compensation for its costs.

ARTICLE 9 - VALIDITY

This agreement is valid from the moment the order is placed and recorded in the system. If the order is placed, the BUYER is deemed to have accepted all the terms of this agreement.

ARTICLE 10 - COMPETENT COURT

In the implementation of this agreement, the Consumer Arbitration Committees up to the value announced by the Ministry of Industry and Trade, and the Consumer Courts at the place of residence of the BUYER or of the SELLER (Ordu), are competent.
